Challenges in International Intellectual Property Protection: A Mixed-Methods Study of Global Legal Frameworks
Abstract
In an era where globalization permeates every segment, the complex challenge of protecting international intellectual property has become complex. Businesses conducting business on an international level experience different legal standards, enforcement inconsistencies. Even a difference in cultural views when it comes to the value of IP. This research is specific to investigating these multifaceted challenges and their implications in terms of innovation and international trade. ​It centralizes around the problem regarding the inadequacy of legal frameworks at a global level about border security for patents, trademarks, copyrights, and trade secrets. Giving special attention to legal and operational variances hindering IP protection.​
Whereby previous works show inconsistencies and implementation weaknesses of the IP laws across the globe as highlighted in international treaties-eg, TRIPS Agreements-that still face respective inadequacies in effectuating the levels of protecting rights. Whereby in the context of enforcement and risk mitigation for businesses, much remains lacking. Intellectual Property protection study bridges the gap with a mixed-methods approach by conducting qualitative interviews with IP attorneys, business executives, and policymakers, focusing on real-world issues, and presenting quantitative analysis based on IP violation and litigation data that provide an overview of statistics related to how different legal systems impact global IP protection.
The study findings indicate several barriers in the existing international IP systems, such as weaknesses in enforcement and inconsistencies in legal standards. These insights are crucial because they inform recommendations on how to improve IP protection strategies while promoting innovation. Answering these questions is important not only for the businesses that have to navigate these complexities. It also for policymakers who seek to create a coherent international system. However, this research contributes to the understanding of how to better the IP frameworks to promote sustainable economic growth and smooth international trade relations in a highly interconnected world.
